Ron Paul: Why Obama Is Wrong on Libya

Congressman Ron Paul, a member of the House Foreign Relations Committee and honorary chairman of Campaign for Liberty, criticized President Obama’s decision to impose a no-fly zone over Libya in a video shot earlier today.

In the video, Congressman Paul argues that:

  1. The action is an act of War.
  2. The no-fly zone is unconstitutional because Congress has not authorized it, a point Senate Foreign Relations Committee Ranking Member Richard Lugar agrees with.
  3. President Obama has illegally seceded U.S. sovereignty to the United Nations.
  4. The United States cannot afford the financial burden of more military action in the Middle East.

      Isolationism is not the same as non-interventionism. I think you’re right about bringing home all soldiers and war-equipment, but all people should be free to trade and communicate with other people outside their own country. Also, I think it would make more sense to liberalize immigration policies to allow more people in legally. Right now it is nearly impossible for many people to immigrate to the U.S. who pose no threat to our security or economic well-being.

      This chart shows the obstacles a person must go through to immigrate legally.

      If we were to reduce those obstacles, people who want to immigrate would go the legal route rather than giving up and just immigrating illegally.

    There is such a thing as international law. I live in England but if you don’t like what the English government has to say on certain things you can take it to the European courts. The United Nations is different but similar to the European courts system. Everything Obama is doings is legal becuase the American governement eg congress and the Senate has agreed to the United Nations Laws at some stage so if the UN makes a decision to go to war Obama does not need approvel from congress etc

      Yes, there is international law. But even if what Obama does is legal under international law (which is debatable), he is still bound by domestic law. There are numerous actions that are not illegal under international law (theft, rape, and fraud, for example) that are still illegal under the law of the U.S. (and that of many other countries). It is illegal under the U.S. Constitution for the president to instigate or authorize any act of war without a formal declaration of war from the congress. Even if the U.N. allows the U.S. to engage in acts of war without a proper declaration and without evidence that such an act is a response to the attack of another state, the U.S. Constitution does not allow it.

      You suggest taking the matter to an international body when the U.S. government violates the rules and rights of it’s citizens. However, history has shown that as long as the U.S. remains the supreme military power, the U.N. will not prevent it from committing illegal acts of war. Especially as long as the U.S. has veto power through the Security council, it will not be hindered by U.N. efforts, even if the U.N. did try to halt these acts of war. Besides, the ICJ only accepts cases wherein the plaintiff and defendant are different states or are entities of different nationality. (In other words, the two states could sue each other or a U.K. citizen could sue the U.S., but a citizen cannot sue it’s own state because there would be no foreign element in that lawsuit.) Furthermore, a state is not obligated to accept the lawsuit of an individual, only that of an other state.

      The only recourse the people of the U.S. really have is to take the president to the Supreme Court, which would judge the constitutionality of his actions. I highly doubt that would make a difference, though, since the Supreme Court has long since strayed from it’s original purpose and tends to re-write the constitution to conform to the choices of other government entities rather than hold those entities accountable to an unwavering constitution.
