Statement Introducing Unpasteurized Milk Bill, HR 1830

Mr. Speaker, I rise to introduce legislation that allows the shipment and distribution of unpasteurized milk and milk products for human consumption across state lines. This legislation removes an unconstitutional restraint on farmers who wish to sell or otherwise distribute, and people who wish to consume, unpasteurized milk and milk products.

Hard as it is to believe, the federal government is actually spending time and money prosecuting small businesses for the “crime” of meeting their customers’ demand for unpasteurized milk! Recently the Food and Drug Administration conducted a year-long sting operation targeting Rainbow Acres Farms in Pennsylvania. As a result of this action, Rainbow Acres’ customers will no longer be able to purchase unpasteurized milk from this small Amish farm.

Mr. Speaker, many Americans who the government wishes to deny the ability to purchase unpasteurized milk have done their own research and come to the conclusion that unpasteurized milk is healthier than pasteurized milk. These Americans have the right to consume these products without having the federal government second-guess their judgment about what products best promote health. If there are legitimate concerns about the safety of unpasteurized milk, those concerns should be addressed at the state and local level.

I urge my colleagues to join me in promoting individual rights, the original intent of the Constitution, and federalism by cosponsoring my legislation to allow the interstate shipment of unpasteurized milk and milk products for human consumption.

Mr. PAUL introduced the following bill; which was referred to the Committee on Energy and Commerce


To authorize the interstate traffic of unpasteurized milk and milk products that are packaged for direct human consumption.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,


(a) Sale Allowed- Notwithstanding the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 et seq.), section 361 of the Public Health Service Act (42 U.S.C. 264), and any regulations or other guidance issued under such Act or section, a Federal department, agency, or court may not take any action (such as administrative, civil, criminal, or other actions) that would prohibit, interfere with, regulate, or otherwise restrict the interstate traffic of milk, or a milk product, that is unpasteurized and packaged for direct human consumption, if such restriction is based on the determination that, solely because such milk or milk product is unpasteurized, such milk or milk product is adulterated, misbranded, or otherwise in violation of Federal law.

(b) Definitions- In this section, the following definitions apply:

(1) The terms `interstate traffic’, `milk’, and `milk product’ have the meanings given those terms in section 1240.3 of title 21, Code of Federal Regulations (as in effect on the date of enactment of this Act).

(2) The term `packaged for direct human consumption’ means milk and milk products that are packaged for the final consumer and intended for human consumption. Such term does not include milk and milk products that are packaged for additional processing, including pasteurization, before being consumed by humans.

(3) The term `pasteurized’ means the process of heating milk and milk products to the applicable temperature specified in the tables contained in section 1240.61 of title 21, Code of Federal Regulations (or successor regulations), and held continuously at or above that temperature for at least the corresponding specified time in such tables.

  • The treatment of the people earlier this month at Rawsome in California is deplorable. It is not the government’s job to tell us what we can and can’t eat.

    It is an absolute travesty, and is completely consistent with the present government’s destruction of the Bill of Rights….have we forgotten that this is a Republic?

    Everyone with an interest in this legislation should know that the CDC’s own data has proven that well produced raw milk from grass fed animals is safe. There is no further need to debate what history, science, and NINE MILLION citizens in the United States who drink raw milk every day, day after day, year after year, already know. Raw milk is good safe food which should be decriminalized post haste.

    “From the perspective of a national public health professional looking at an estimated total of 48 million foodborne illnesses each year; or from the perspective of a healthcare professional looking at a total of 90,771 (data from Healthy People 2004) confirmed bacterial foodborne infections each year (about 0.2 percent), there is no rational justification to focus national attention on raw milk, which may be associated with an average of 42 illnesses maximum among the more than nine million people (about 0.0005 percent) who have chosen to drink milk in its fresh unprocessed form.

    Using this average of 42 illnesses per year, we can show, using government figures, that you are about 35,000 times more likely to become ill from other foods than you are from raw milk.”


  • There seems to be only one problem with the bill. The term `pasteurized’ and the definition presented is limited. They use systems of pasteurization by adding antibiotics to kill bacteria and not even heat the milk. Thus they could require bacterial warfare tactics requiring raw milk (unheated) be treated witch such to cross state lines or sell it. Do you realize the big money savings ad to it the big boom in money to chemical and bacterial engineers to pasteurize without using heating costs?

    The bill needs to be more comprehensive to assure freedom.

    Also Obama is working on allowing GMO crops to be planted in wilderness areas. This spreads modified organisms into the good Creation. Where are the Environmentalist to protect man and creation with Monsanto’s evil practices.

    They are practicing biological warfare and nobody seems to see it or say anything about it in the mainstream. They are still working to cut the world population to 500 million total. Globalist, NWO types are doing this.

    Less than 100 yrs. ago most people drank and ate foods that were from grass fed animals. Now all animals are fed genetically altered feed, antibiotics and other sthuff not straight from mother nature. Look in the mirror and ask yourself which is for more optimum health. Man made chemically altered crap or straight from mother nature? You are the change that you see in the world today and you are more powerful than you believe. And ignorance can be as loud as protest.

Children eat more junk here than anywhere else and nothing is said about this. I have been drinking raw milk for many years and not once has it hurt me. I refuse to drink pasteurized milk for I know it is harmful and is not good. Let the government go after criminals and stop trying to control the good people in our nation. Raw milk is one of the healthiest foods on earth. Stop trying to ban our great raw milk. Stop trying to rule us as if we are your slaves.     a doctor named william campell douglass 11 discoved that pastuerization alters the protien and fats in the milk, zaps all the enzmes and vitamins and destroys all the probiots in the milk that our body needs to properly digest it and that is why you have people that are lactose intolerant and have allergies to the milk.

    Wow, Ann’s comments are simply ridiculous. She gives the impression that raw milk causes ramped illness and always has and would if it were up to people’s freedom to choose it. She sights no proof, just claims. Her bias is so obvious and she doesn’t give complete information about bacteria. Does she know the difference between cancer and illness causing bacteria and and bacteria that gives life and healthy life to the biological creatures we are? I think not. We don’t eat concepts and were are well. There is all the difference in the world!

    I have tested raw milk and it amazes me. I could let the milk set for weeks in the refrigerator and it doesn’t spoil. I can take adulterated factory milk and it spoils within days in the refrigerator with all their “antibiotics” in it. What does her support of the milk industry bias have to fear if people want to drink raw milk? If their adulterated milk is so much more desirable, people will buy it. The market will drive their stuff and others will collapse if people don’t like it and don’t want it. But I think she actually wants to force the others out of business because she wants to gain dividends from her milk owned stock (if she has some stock, but if not I would be surprised). Does she think sour milk is spoiled milk? If so she is ignorant about good and bad bacteria.

    In her closing statements she gives the impression the FDA and the food safety is impeccable in this country and we have case (science) study one after another where un-natural manufactured and un-natural processed foods of many sorts causes diseases ALL THE TIME. Yet we have not such with natural food. People ought to get a clue, we are not un-natural being in the flesh that we can put anything synthetic we want in our bodies and it has NO EFFECT. What about the non-science study of the man that saved McDonald’s hamburgers for years and they remain the same…. and that is food? He tried to eat it only and became sick very quickly yet that is approved by what she calls “the most safest food possible”!

    Man has had thousands of years to come along and not get sick with natural foods and yes raw milk, raw cheese etc.

    But I have to admit, her words sound authoritative but I am surprised of her quoting the illiterate in this land and in the same letter say she was professional educator. It should tell you that government definition of “good”systems didn’t work.

    One optimistic fact is the system that has caused so much sickness, disease, illness and death has a certain end. It does not propagate life but propagates death. So it has no choice but to die off. Those that know how to propagate life and healthy life at that will survive to make it so. But those death propagators must not be allowed to continue and it is all about freedom of choice of the individual in a representative republic disposition.

    Ann, if you don’t want to drink raw milk simply don’t. Let others choose for themselves. If you think your education and opinion is important you surely have the right to say it but don’t allow the government or yourself to enforce your way and stop us. We can prove your food system causes sickness yet your system goes out with guns and keeps your system going and takes other peoples freedom of choice. … What if we did that to you and your system?

    Sick systems are enforced by violent sick people using the government law oppression(ors) and the ridiculous FDS going in by arms to invade a man’s home and life is insane. They are the terrorist, can’t you see the truth? They have no right to do that. There are such things as illegal laws.

    We also need to get rid of the monopolistic effects of mono cultural products and development systems. It is the monolithic mentality of large businesses that have fought to stop true free competition at the behest of the environment and human life and the spirit of life giving innovation, creation, invention and a free market for people to choose what they want.

    When we package a food and put it in commerce across state lines – whether in a grocery store, restaurant or other venue, we are telling people that what we sell is safe to consume. That’s even the way the law is written in Tennessee and many other states as far as liability in foodborne illnesses lawsuits.

    There is no practical or legal way to make raw milk and all raw milk cheese safe for consumption since the harmful bacteria that get in raw milk are naturally present in the milking environment. Many can grow under refrigeration. Milk is known to carry at least 14 different disease causing bacteria such as Salmonella, hemorragic E. coli and Listeria monocytogenes. One of the oddest reports that I’ve seen published is 80 people in Massachusetts who had to be immunized for rabies after drinking raw milk from two rabid cows (Centers for Disease Control, MMWR 48:228-229.).

    The further we take the milk from the farm, the greater the risk since bacteria have time to grow and increase in numbers over time. Many farm families drink raw milk with no problem but they don’t store it for long periods or take it to other states. Drinking raw milk that is handled, packaged and transported is a little like playing Russian Roulette – about 75% of the time it is safe. In the words of Clint Eastwood ” Do You Feel Lucky?”

    I have been a food safety professional and educator at a university for over 30 years. I care deeply about the health of every American and have spent my life trying to improve the safety of the U.S. food supply through education and research. There is a fairly good article written in straight-forward English in the April 2009 issue of a refereed (peer reviewed) scientific publication “Food Protection Trends” – pages 211 to 222 on Foodborne Disease Outbreaks Associated with Raw Milk. This is published by the International Association for Food Protection – the foremost professional association in the world dedicated to protecting the safety of food. I suggest anyone who plans to drink raw milk or feed it to their children read the research. It presents both sides of this issue.

    As a Libertarian, I think government should generally stay out of our business and that we have the right to eat whatever and any quantity or type of food that we want. I admire Ron Paul and support his stand on many issues but I think his aids have let him down on this bill by not providing him sufficient information.

    With only 42% of dairy farmers (in a PA study) aware that milk can carry pathogens (what’s a pathogen? – LOL) , the average consumer is clueless about this issue. They get their science “facts” from a family member, the news or off the internet. Then we add to that the junk science that has shown that drinking raw milk cures everything from cancer to asthma. Some children with digestive issues may actually do better with raw milk that is not homogenized. But, the risk of infection is high. It is usually the kids with leukemia or people with chronic illnesses who end up paying the ultimate price although healthy people sicken and die from illnesses associated with raw milk consumption also.

    I don’t ever want to see raw milk NEXT to the pasteurized milk in the dairy case or served at a restaurant or farmer’s market since people are more likely to try it. Plus, there are scientific studies in reputable refereed journals showing growth of ONE foodborne disease causing bacterium from raw milk to 1,000,000 per ml within a week under refrigeration. With most of the bacterial foodborne diseases, it takes about 1000 cells to cause illness, although some can cause illness with as little as 10 cells.. It doesn’t take long to reach those levels if harmful bacteria are present.

    Approximately 14% of Americans (32 Million) cannot read the instructions on a bottle of pills, 25% of Americans are functionally illiterate (can’t find specific information in an article or fill out a form). Only about 20% of 12th graders in the U.S. are considered proficient in Math and Science and 40% in Reading (US DOEd , . It is irresponsible to sell food that may be dangerous when people do not have the scientific information or knowledge to make a wise choice.

    We put warnings on packages of ground beef to cook them, but raw milk is a food intended to be consumed raw even if people can and do read the packages. Warning labels of death or injury would definitely be appropriate on packaged raw milk in interstate commerce since the risk is very high. One study done in our laboratory with over 250 farms found that 1 out 4 raw milk samples contained at least one pathogenic (harmful) bacterium.

    This bill is not only not good for Americans, but also most definitely not good for our food safety system in the U.S. since people will lose confidence in the government’s ability to regulate foods and ensure the safest food supply possible. Most people will not connect their illnesses or their child’s death to their own irresponsible decision to drink raw milk, instead they will place the blame squarely on the market that sold it to them and on other parts of the food system including regulatory. They will contact their attorney – feeling righteously that they have been violated and deceived. And they will be right…..

    This is not about our rights or even our beliefs – it is about science. Please read the science (not junk science) and make an informed decision.

      What some people don’t seem to understand is that any good or service could potentially result in harm to the consumer, which means that it is both unnecessary and impossible for the government to protect us from potentially harmful products. Should we ban the sale of cars simply because death by car accidents is so frequent? Of course not. The majority of people who use cars go unharmed. In the same way, the majority of people who drink raw milk are not harmed by it. Rather than holding the buyers and sellers of raw milk (or any product) responsible, we should allow adult consumers to face the consequences of whatever risky choice they make. In the rare case that a parent repeatedly serves a child raw milk even when the child’s body has had a negative reaction to it, the parent can be held liable for child abuse/negligence, just as any parent would be if s/he knowingly poisoned a child. It is ridiculous to think that we can or should prevent parents from serving their children anything that might possibly make them sick. After all, most any food product causes an allergic reaction to some child somewhere, and until a child consumes it, there’s no way to know that the allergy exists. Once the allergy is apparent, however, parents are of course required to not serve harmful food/drinks to their children that would cause an allergic reaction. Again, that has to do with abuse/negligence law, not the monitoring of any specific product.

      Dear Ann Droughon,

      Sorry my dear but I am a licensed doctor and am well aware of when and why we began pasteurizing milk. It began because of brucellosis, a disease we have now eradicated through vaccination of all dairy cows. Yes, ecoli may contaminate raw milk and people with poor immune systems may be sickened or die from drinking ecoli contaminated milk. Interestingly, though, when we hear of these things occurring, and people dieing, it is almost always with mass produced milk, veggies, eggs and meats. It is almost never with small farm produced.

      You state that “It is irresponsible to sell food that may be dangerous when people do not have the scientific information or knowledge to make a wise choice” but I ask you- is not this true of genetically engineered foods? No one has enough knowledge to know if they are safe. Not even your so called “scientists” And yet, the USDA and FDA has no issue with them being fed to the unknowing public. Also, we know for a fact that consumption of fast food is long term dangerous- and yet, we do not stop people from eating fast food oon a daily basis. The reality is, of course, that ALL food “may be dangerous” That is a fact of life.

      The issue here is democracy, plain and simple. We do not and must not allow our government to play “mommy and daddy” and take away our constitutional rights. If people wish to consume raw milk, and I do, myself, they must be allowed to. Just as if you wish to consume fast food , I will not stand in your way. This is how, actually, this country is supposed to work. If I have a superior product, people will buy it and the inferior products will lose money and die out. But what we have occurring in this country at this time are agencies that were set up to protect the consumer now acting to protect big business.

      This is a very very serious situation. If we do not fight this, and fight hard, we will lose what little of our democracy we have left. And that is not a pretty picture.

    there are more ways that their industry pasteurizes, such as loading it with antibiotic systems. Also, limiting transportation to only interstate may cause states or other special interests say one cannot move it from one place to another intrastate.

    There should be no restrictions in movement nor who can buy it and consume it or produce it and sell it with one’s own state, county or city.

    Thank you Ron. For this bill. I have watched many infants struggle with stomach trouble from one kind to another because of the baby formulas we have had 3 babies who we put on raw milk and they had no trouble. no throwing up no constapasion no stomach pain. why are people so afraid of it? raw milk is all there use to be. my mom, mother inlaw grandparents all drank it , no formulas and no acid reflex no stomach trouble. Thank you for trying. we should have the right to what we feel is best for our children not the federal gov. they dont know our children. I see more and more the things they say we should give our children is harming our children! keep up the fight

    Ron Paul thank you for trying to help make unpasteurized milk legal! It actually makes me cry to think of that Amish farmer getting shut down. 🙁 They never did anyone any harm and I have friends who are Amish. They are really nice people and only want to help people and there own families. They even treat the cows nice and let the cows eat grass like there suppose too! I really hope that this bill gets passed and if it doesn’t we keep on fighting for our freedom. Thank you again.
