Ron Paul: Founders Would Be Horrified by Pro-Obamacare Legislators

Last week President Obama made some rather shocking comments at a press conference regarding the Supreme Court’s deliberation on the constitutionality of the Patient Protection and Affordable Care Act, or Obamacare. His comments belie a grasp of constitutional concepts so lacking that perhaps the University of Chicago Law School should offer a refund to any students “taught” constitutional law by then-Professor Obama!

He said, “Ultimately, I’m confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress.” It almost sounds as if he believes the test of constitutionally is whether a majority approves of the bill, as opposed to whether the legislation lies within one of the express powers of the federal government. In fact, the very design of the Constitution, with power split amongst two branches of the legislature which write the laws, an executive who administers the laws, and an independent judiciary which resolves disputes regarding meaning of the laws, was designed to thwart popular will and preserve liberty.

President Obama continued in his comments, “For years, what we’ve heard is the biggest problem on the bench was judicial activism or a lack of judicial restraint, that an unelected group of people would somehow overturn a duly constituted and passed law. Well, there’s a good example, and I’m pretty confident that this court will recognize that and not take that step.”

President Obama seems to misunderstand that the criticism of an activist judiciary is not that it is overturning unconstitutional federal laws, but instead that it is usurping the authority to intervene in areas, such as abortion, where the Constitution reserves authority to the states. In fact, upholding clearly unconstitutional laws such as Obamacare because the justices bowed to the “will of the people” or believed the individual mandate was good social policy could be considered an example of judicial activism.

The founders never intended the judiciary to have the last word on whether or not a law is constitutional. The judiciary is equal to the Congress and the President, not superior. Representatives, senators, presidents, and judges all have an independent duty to determine a law’s constitutionality. The founders would be horrified by the attitude of many lawmakers that they can pass whatever laws they want and federal judges will then determine whether or not the law is constitutional.

Additionally, state governments have the authority to protect their citizens from federal laws that threaten liberty. If the Supreme Court rules that Obamacare is constitutional, I hope state legislators will exercise their powers to pass legislation allowing their citizens to opt-out of the national health care plan.

Unfortunately, even many of my colleagues who correctly argue Obamacare’s unconstitutionality support the President when he asserts the power to send troops into battle without a declaration of war, or have citizens indefinitely detained and even assassinated on little more than his own authority. Other of my colleagues not only cheer the unconstitutional monstrosity of Obamacare, but support the President’s actions to defy the Senate’s appointment powers, and legislate by executive order.

Even worse, some members will only challenge a President’s unconstitutional actions if the President is from a different political party. The defeat of Obamacare in the courts would provide a stark reminder that the limits of government are set by the Constitution, not the will of the President, Congress, or even the Supreme Court. However, the victory would be short lived as long as the legislative branch refuses to do its duty to abide by the Constitutional limits and exercises its powers to ensure the other two branches do likewise.

  2. Are you stupid enough to believe that by not changing it that it will get better. What he can do is use the bully pulpit to whip this government back into a Constitutional format. He can repeal any unConstitutional regulation and Executive order. He can control spending. End the wars. Reform the banking policies and authorize commodity based money. Get out of the UN. Repeal the NDAA and the NDRPA - those are the things he can and will do.

  4. The Ron Paul folks know what's going on. But it's like trying to put round pegs into square holes. The people who watch that stupid tv all day are brainwashed into a little thought box. Anything outside that box is impermissible. And Ron Paul is not in the box that includes Mitt Romney, Nancy Pelosi, Hillary Clinton, Obama, and the other degenerate Communists running this governement.

    Ron is old school free market economics taught my Ludwig Von Mises, Rothbard, and Laissez-faire economists.

    Cronyism is the blending of big government and business to control a particular sector. Ron wants to get out of that entire system. He calls it the Status Quo - and its destroying our country.

Johnson began the 2012 race running for the Republican nomination but has wound up carrying the libertarian banner and could gain ballot access in several states.”

    If the above transpires, it is a certainty that Mitt will not defeat BO (with his flip-flopping, he couldn’t defeat him anyway, now this would assure it).

    So he needs to withdraw now in favor of Ron Paul!

    Ron Paul WILL become President in 2012 — IF, Romney becomes a Patriot, and forgoes his ego, for the Good of the People!

    Mitt Romney could become one of the greatest Statesmen in US History! He’d be the Savior of our Nation — the one that generations to come would tell their children: “Look at this statue, this is Mitt Romney, he saved America”!

    Or, he can reduce himself to just a tiny footnote…what is amazing is that his fate rests in his own hands (a very rare occurrence throughout the history of the world)!

    All Romney has to do, is to take advantage of this rarest of historical moments, and make a SINGLE DECISION!!!

    Withdraw his candidacy IN FAVOR of Ron Paul, with the following grandiose and heart-wrenching patriotic speech (to save his political skin):

    “I, Mitt Romney, will sacrifice my political goals for the Good of the People. Now I understand that only Ron Paul that can save our Nation. I agree with all he stands for, therefore, I have deemed that our Nation’s salvation can only be accomplished when Ron Paul is elected as President of the United States of America. Without regret, but with joy, I do the most honorable and patriotic deed I can — I withdraw myself from this election, and give my full support to Ron Paul!”

    One honest person is needed to bring these logical conclusions to Romney’s PERSONAL ATTENTION (not the myopic sycophants surrounding him and stroking his ego by chanting wishful thinking as ‘fact’: “You gonna win Boss, you gonna win Boss….).

    Regardless how egotistical, arrogant and narcissistic Romney may be, some semblance of reasoning of what’s best for him, should still remain in his skull. The instinct for self preservation dictates that even the smallest of minds will chose the path that leads to safety, not the one leading to disaster.

    An honest realist needs to talk to Romney one-on-one — and explain the following to him, so Mitt can comprehend it:

    1) If you don’t win the nomination, than your political career is over (you’ll become just a tiny footnote in US History as a failure).

    2) If you win the nomination, and don’t defeat Obama — which is the most probable outcome (you’ll become just a tiny footnote in US History as an even LARGER failure).

    Therefore, Dear Mitt, whichever gamble you take from the above, may lead to total disaster for your political career (and probably will)!

    However, here is an action you can take, Dear Mitt, that guarantees you’ll become immortalized in the annals of US History — becoming the 21st Century Savior of America (surely this carrot of success will entice Romney’s egotism to go for it — over the probable political beatings he’d receive otherwise)!

    All one needs to do, to assure Mitt’s Historical Greatness of Sacrifice for the Good of the Nation, is to present the above to Romney’s eyes alone! I urge all able to do so, to place this document in front of him!

    Send this to Mitt Romney — as an Open Letter, e-mails, etc. — the more you send, the greater the chance he’ll get to read it!

Ron Paul will cut essential services like the EPA that keeps led out of your water makes makes sure that large corporations don't fucking ravage the country so that we have no natural resources left. You can simply cut half the defense budget and most pork barrel spending to cover one trillion. Cutting things like social security and medicare won't do it and they affect you directly. Paying the debt back requires time, surely more time then you have patience for. Ron Paul ain't fixin' nothin'

I never said cut everything -___- But theres a lot we have to cut or else the debt will get bigger and soon you would BE FORCED to not have any service and that would cause a greater chaos, don't you think? Ron Paul will cut $1 trillion. Or we will continue to increase. How do you pay off your credit card debt, if all you do is spend? by spending more? No, you start cutting your spending, but you will still pay your bills and stuff of course. It's common sense -____-

Not sure what you problem is with people like Ron Paul that call out the trouble makers. You think there's trouble makers in here? Wow, you must see with Tunnel vision. There are much more damaging trouble makers out there than any RP supporter. The Fed, the Royal British Monarchy, Treasury, all continuing/ruling a system that borrows into the future.
