Secession: Are We Free to Go?




Is all the recent talk of secession mere sour grapes over the election, or perhaps something deeper?   Currently there are active petitions in support of secession for all 50 states, with Texas taking the lead in number of signatures.  Texas has well over the number of signatures needed to generate a response from the administration, and while I wouldn’t hold my breath on Texas actually seceding, I believe these petitions raise a lot of worthwhile questions about the nature of our union.

Is it treasonous to want to secede from the United States?  Many think the question of secession was settled by our Civil War.  On the contrary; the principles of self-governance and voluntary association are at the core of our founding.  Clearly Thomas Jefferson believed secession was proper, albeit as a last resort. Writing to William Giles in 1825, he concluded that states:

“should separate from our companions only when the sole alternatives left, are the dissolution of our Union with them, or submission to a government without limitation of powers.”

Keep in mind that the first and third paragraphs of the Declaration of Independence expressly contemplate the dissolution of a political union when the underlying government becomes tyrannical.

Do we have a “government without limitation of powers” yet?  The Federal government kept the Union together through violence and force in the Civil War, but did might really make right?

Secession is a deeply American principle.  This country was born through secession.  Some felt it was treasonous to secede from England, but those “traitors” became our country’s greatest patriots.

There is nothing treasonous or unpatriotic about wanting a federal government that is more responsive to the people it represents.  That is what our Revolutionary War was all about and today our own federal government is vastly overstepping its constitutional bounds with no signs of reform.  In fact, the recent election only further entrenched the status quo.  If the possibility of secession is completely off the table there is nothing to stop the federal government from continuing to encroach on our liberties and no recourse for those who are sick and tired of it.

Consider the ballot measures that passed in Colorado and Washington state regarding marijuana laws.  The people in those states have clearly indicated that they are ready to try something different where drug policy is concerned, yet they will still face a tremendous threat from the federal government.  In California, the Feds have been arresting peaceful medical marijuana users and raiding dispensaries that state and local governments have sanctioned. This shouldn’t happen in a free country.

It remains to be seen what will happen in states that are refusing to comply with the deeply unpopular mandates of Obamacare by not setting up healthcare exchanges.  It appears the Federal government will not respect those decisions either.

In a free country, governments derive their power from the consent of the governed. When the people have very clearly withdrawn their consent for a law, the discussion should be over.  If the Feds refuse to accept that and continue to run roughshod over the people, at what point do we acknowledge that that is not freedom anymore?  At what point should the people dissolve the political bands which have connected them with an increasingly tyrannical and oppressive federal government?  And if people or states are not free to leave the United States as a last resort, can they really think of themselves as free?

If a people cannot secede from an oppressive government, they cannot truly be considered free.

  1. Yes, we need to secede. However, this secession must be to a new society that respects individual rights and to a new government that is limited to only providing protection of life, liberty, and property.

    In practical terms, a few thousand secessionists in 50 different states will not find success. A place must be chosen. It must be small...and perhaps with a strong movement already. Alabama, Louisianna, perhaps even New Hampshire come to mind.

    And, this movement will need leaders...business leaders. We all live real lives with real jobs. How many of us would give up our jobs and our homes to move to this "new society" --- especially when future empliyment becomes unknown? However, with business leaders sympathetic to freedom commit to hiring those seeking freedom, perhaps they will "set up shop" in this new location. And, yes, I am thinking of the owner of Whole Foods...but, I am certain there are others.

    This can work, but only if we move itbeyond this website.

    I will leave you with this thought by Murray N Rothbard...he believed that all government should be voluntary. This means even a society that has a government that only provides protection must not demand every individual in its jurisdiction be subjected to its laws.

    You are either for FREEDOM...or oyu are against it.

  3. I'm not familiar with HR-347 offhand, but I'm saying yes to the rest of them. Obamacare even passed Supreme Court review (the ultimate test of Constitutionality) and passed with the caveat that they call a spade a spade and a tax a tax.

  6. Revolution, with Ron Paul. Nov. 20, 2012

    Introduction. A proper Revolution is a revolt against tyranny. It should be seen as a War, to be won in a series of battles. It should be planned carefully, with strategies based on the Enemy against whom the battles are to be waged. This requires not only identifying the Enemy, but in learning of his strengths and weaknesses.

    It also requires considering our own strengths and weaknesses. Who are we? Just a bunch of disorganized “occupiers”, with no real agenda other than their current “me too” isms? Or, are there really wrongs that need correction? And, finally, how do we go about preparing for out War, our Revolution?

    The Enemy. The Government is too big? Yes, indeed it is. A bunch of bureaucrats whose only goal is power, the power to “feather their nest”, the power “to do” without accountability, the power to get re-elected for another term, etc., etc. Their army? The people that vote them into office. The people that hope to be cared for, for the rest of their lives, not realizing where we’re going as a Nation. The people who’ve been “carefully taught” to hate (from “South Pacific”). All of whom are ostracized if they dare to roam outside the confines of “conventional wisdom”.

    Our Arsenal? We must teach them otherwise, both the people and the bureaucrats (those capable of being reached). We must teach them the meaning of “Life, Liberty and the pursuit of Happiness”, for the individual. We must teach them the meaning of “not to initiate force against another”, whether physical, or financial, or emotional. This means talk and speeches by everyone, especially by those whose credentials are of the highest order.

    Our Army? Ron Paul is the current leader, the one who has identified the basic problems and has spoken of them for some 30 years in Congress, with little effect. They just don’t hear and that because they won’t listen to anything that rocks their cradle. We must waken them, both the people (the Voters) and those in Congress who are honestly misled. Dr. Paul must have a Cabinet (or War Council) of perhaps a dozen intellectuals, with a second in command, who work with him to plan the strategy for the battles to be fought in each of the 50 States. There are a lot of men and women in this Country who would be delighted to have a platform from which to speak. Find them. Use them.

    First, we need a convention of our own (perhaps in Texas) in March or April, of 2013, to organize for our War and plan our strategies. Such strategies must be flexible, adaptable to meet the varying demands and opportunities, but directed from the top where the information on our Enemies is collected and analyzed. We don’t have a lot of time, maybe three of less than four years. Speakers should be found everywhere to talk at High School, at Colleges and Universities, to business men’s conventions, to Local, State and National assemblies, etc., etc. And, while the Internet is a powerful tool for advertising and promotion, it could provide a point of vulnerability. Remember that the Media is in bed with the Enemy, for the most part.

    Now, while this War should be one of Reason and discussion and debate, recall that the Enemy stands to lose heavily if we win. Protection should be afforded to those most exposed, and especially to out Leaders. Funds should come from donations, but also from fees charged for providing The Speaker at conventions, where feasible. And, in a “Free Enterprise” system we pay our way, so where proper, wages and salaries and expenses should be paid.

    "I lived in a Communist Country that was totalitarian. In the morning I woke up to TV news that told me how great our Socialist Government was, then read the same in their newspapers, while waiting in line for bread. I was then 16 years old.

    My parents went to work before the break of dawn, and came home exhausted each day after 7pm.     I'm sadden to recall that there were a few children that reported their own parents (these children did get an extra allowance of candy, AND THE RARE Chocolate bar...and we envied them, since Chocolate was an unheard of luxury back then), but next time we never saw their parents....

    But I loved my parents and respected them --- and no Chocolate bar could ever replace them.

    We did escape in 1968 --- and came to Freedom, the Greatest Country in the World back then, the USA!

    My parents died in the 1980's, and I no longer mourn them --- because I'm happy they did not live to see what this nation has become!"

    Just pack your bags and go; there is nothing to stop you from "self-secession."

    The issue here is not secession but the ability to take United States property and territory with you. That is what this is all about. Each state has considerable property in the form of office buildings, courthouse, military bases, highways, national parks and monuments, national forests or hoer real estate. That property belongs to all Americans, not just those in which the property is located.

    So if life in the United States is so intolerable for you, just exercise your freedom for self-secession and go. You just can't take United States property and territory with you.
