Ron Paul supports the elimination of the income tax and the Internal Revenue Service (IRS). He asserts that Congress had no power to impose a direct income tax and has introduced legislation to repeal of the 16th Amendment to the Constitution, which was ratified on February 3, 1913.

An income tax is the most degrading and totalitarian of all possible taxes. Its implementation wrongly suggests that the government owns the lives and labor of the citizens it is supposed to represent. Tellingly, “a heavy progressive or graduated income tax” is Plank #2 of the Communist Manifesto, which was written by Karl Marx and Friedrich Engels and first published in 1848.

To provide funding for the federal government, Ron Paul supports excise taxes, non-protectionist tariffs, massive cuts in spending.

Ron Paul discusses the income tax and the “FAIR Tax” in May 2007:

On November 20, 2008 Ron Paul said in a New York Times / Freakonomics interview:

“I want to abolish the income tax, but I don’t want to replace it with anything. About 45 percent of all federal revenue comes from the personal income tax. That means that about 55 percent — over half of all revenue — comes from other sources, like excise taxes, fees, and corporate taxes.

We could eliminate the income tax, replace it with nothing, and still fund the same level of big government we had in the late 1990s. We don’t need to “replace” the income tax at all. I see a consumption tax as being a little better than the personal income tax, and I would vote for the Fair-Tax if it came up in the House of Representatives, but it is not my goal. We can do better.”

On May 7, 2001, Ron Paul wrote the following column:

The Case Against the Income Tax

Could America exist without an income tax? The idea seems radical, yet in truth America did just fine without a federal income tax for the first 126 years of its history. Prior to 1913, the government operated with revenues raised through tariffs, excise taxes, and property taxes, without ever touching a worker’s paycheck. In the late 1800s, when Congress first attempted to impose an income tax, the notion of taxing a citizen’s hard work was considered radical! Public outcry ensued; more importantly, the Supreme Court ruled the income tax unconstitutional. Only with passage of the 16th Amendment did Congress gain the ability to tax the productive endeavors of its citizens.

Yet don’t we need an income tax to fund the important functions of the federal government? You may be surprised to know that the income tax accounts for only approximately one-third of federal revenue. Only 10 years ago, the federal budget was roughly one-third less than it is today. Surely we could find ways to cut spending back to 1990 levels, especially when the Treasury has single year tax surpluses for the past several years. So perhaps the idea of an America without an income tax is not so radical after all.

The harmful effects of the income tax are obvious. First and foremost, it has enabled government to expand far beyond its proper constitutional limits, regulating virtually every aspect of our lives. It has given government a claim on our lives and work, destroying our privacy in the process. It takes billions of dollars out of the legitimate private economy, with most Americans giving more than a third of everything they make to the federal government. This economic drain destroys jobs and penalizes productive behavior. The ridiculous complexity of the tax laws makes compliance a nightmare for both individuals and businesses. All things considered, our Founders would be dismayed by the income tax mess and the tragic loss of liberty which results.

America without an income tax would be far more prosperous and far more free, but we must be prepared to fight to regain the liberty we have lost incrementally over the past century. I recently introduced “The Liberty Amendment,” legislation which would repeal the 16th Amendment and effectively abolish the income tax. I truly believe that real tax reform, reform that so many frustrated Americans desperately want, requires bold legislation that challenges the Washington mind set. Congress talks about reform, but the current tax debate really involves nothing of substance. Both parties are content to continue tinkering with the edges of the tax code to please various special interests. The Liberty Amendment is an attempt to eliminate the system altogether, forcing Congress to find a simple and fair way to collect limited federal revenues. Most of all, the Liberty Amendment is an initiative aimed at reducing the size and scope of the federal government.

Is it impossible to end the income tax? I don’t believe so. In fact, I believe a serious groundswell movement of disaffected taxpayers is growing in this country. Millions of Americans are fed up with the current tax system, and they will bring pressure on Congress. Some sidestep Congress completely, bringing legal challenges questioning the validity of the tax code and the 16th Amendment itself. Ultimately, the Liberty Amendment could serve as a flashpoint for these millions of voices.

Ron Paul introduced the Liberty Amendment in 1998, 1999, 2003, 2005, 2007 and 2009. It is currently know as H. J. RES. 48 and has 2 cosponsors, Roscoe G. Bartlett (MD-6) and Don Young (AK). Here is the text of the proposed amendment:

Liberty Amendment

Section 1. The Government of the United States shall not engage in any business, professional, commercial, financial, or industrial enterprise except as specified in the Constitution.

Section 2. The constitution or laws of any State, or the laws of the United States, shall not be subject to the terms of any foreign or domestic agreement which would abrogate this amendment.

Section 3. The activities of the United States Government which violate the intent and purposes of this amendment shall, within a period of three years from the date of the ratification of this amendment, be liquidated and the properties and facilities affected shall be sold.

Section 4. Three years after the ratification of this amendment the sixteenth article of amendments to the Constitution of the United States shall stand repealed and thereafter Congress shall not levy taxes on personal incomes, estates, and gifts.’.

On April 30, 2009 Ron Paul introduced the Liberty Amendment with the following speech:

Ron Paul: Madam Speaker, I am pleased to introduce the Liberty Amendment, which repeals the 16th Amendment, thus paving the way for real change in the way government collects and spends the people’s hard-earned money. The Liberty Amendment also explicitly forbids the Federal government from performing any action not explicitly authorized by the United States Constitution.

The 16th Amendment gives the Federal government a direct claim on the lives of American citizens by enabling Congress to levy a direct income tax on individuals. Until the passage of the 16th amendment, the Supreme Court had consistently held that Congress had no power to impose an income tax.

Income taxes are responsible for the transformation of the Federal government from one of limited powers into a vast leviathan whose tentacles reach into almost every aspect of American life. Thanks to the income tax, today the Federal government routinely invades our privacy, and penalizes our every endeavor.

The Founding Fathers realized that “the power to tax is the power to destroy,” which is why they did not give the Federal government the power to impose an income tax. Needless to say, the Founders would be horrified to know that Americans today give more than a third of their income to the Federal government.

Income taxes not only diminish liberty, they retard economic growth by discouraging work and production. Our current tax system also forces Americans to waste valuable time and money on compliance with an ever-more complex tax code. The increased interest in flat-tax and national sales tax proposals, as well as the increasing number of small businesses that question the Internal Revenue Service’s (IRS) “withholding” system provides further proof that America is tired of the labyrinthine tax code. Americans are also increasingly fed up with an IRS that continues to ride roughshod over their civil liberties, despite recent “pro-taxpayer” reforms.

Madam Speaker, America survived and prospered for 140 years without an income tax, and with a Federal government that generally adhered to strictly constitutional functions, operating with modest excise revenues. The income tax opened the door to the era (and errors) of Big Government. I hope my colleagues will help close that door by cosponsoring the Liberty Amendment.

    Eliminating the taxes completely is not possible for government, ultimately this tax is used for peoples welfare but the thing is that if we work smartly our taxes can be reduced, for this purpose we can even hire an adviser.

      95%of all Americans do not need to pay taxes…read the book “Cracking the Code” by Pete Hendrikson or down load it from LostHorizons.com. I did and am now receiving back refunds for the last three years and will try to get the last ten refunded because taxes were withheld illegally….READ and LEARN and quit complaining!!

    The problem is that too many Americans spend the bulk of their time on frivolous activities, such as watching mainstream media-liars, soap operas, game shows, reality TV, Oprah, sports channels, Face book, twitter, iPods, Xbox, Nintendo, computer games, Anime, the Oscars, Satanic pop culture and music and others. Most Americans have been so brainwashed by mainstream television and radio and are totally distracted in trivial pursuits to care enough about the really important issues of their and even their children’s futures! Not enough Americans read books or get on the computer to do any real important research of current events concerning politics and their government! They are not reading the Constitution, the Bill of Rights, the truth about the history of our founding fathers and American History, let alone World History! The truth that this country is in fact founded on Christianity, not Islam or any other false religion!

    Not to mention the fact that mainstream America has fallen away from their roots, they have forgotten God! So many people question why things have ended up as they have, why our country is in such deterioration? I have heard so many people when asked what needs to be done; answer by saying that they do not know the answer. The answer should be obvious to them. When a society has left its moral and Godly convictions, because everyone wants to do their own thing and not be held accountable, they begin to overlook everyone else’s immoral behavior including their politicians, least someone might have something to say about their own immoral behavior!

    Very few parents are taking the time to educate themselves or their children. They have turned the education of future generations over to their immoral and corrupt government! They don’t educate themselves in the best history book available as well as the best moral guide with words of tremendous wisdom, the Holy Bible. Again Americans call themselves Christian, but they do not want to behave like Christians. Then they wonder why their government is so corrupt? It is impossible to separate Church and State and end of with moral politicians!!! You cannot have your cake and eat it too. If you want Godly men and women to rule over you, then you must be Godly yourself!

    They say why vote? The next guy will be as bad as or worse than the last! They say I am just one person, what can I do? They say I don’t care about voting. Imagine that, they don’t care about their or their children’s future! They have plenty to say in complaint of the decay of their country and government, but don’t ask them to actually get up and make any real effort to do anything about it. Ignorance is certainly not bliss, and we should all be aware of this fact by now! And one does not have to be a high school graduate or college graduate to educate themselves, all it takes is the desire and determination to make the effort to learn!

    Wake up people! Stop whining and complaining, stop being so dammed; yes I said dammed, complacent and get yourselves educated so you can teach your children and turn this country around before we are all forced into this God forsaken New World Order!!! Before it becomes final and one no longer has the choice to be lazy about their faith, because they no longer have a choice; their faith will be chosen for them and enforced!! Throw off the so called New Age Enlightenment nonsense and get back to reality! If I have offended anyone, well good!! Maybe it might insight some real passion in your hearts to get active and do something worth wile for a change!

    America a Democracy? This is a flat out lie that the politicians and the media have been feeding the public. We are a Republic and want to stay that way. Democracy leads to huge government and loss of freedom. The flat tax sounds like a good idea and to be governed by the states, not the federal government. We must seriously reduce the federal government and take back our country! Corporate America and the rich need to pay a slightly higher tax above others and the rest may need to pay more taxes to get us out of the mess the federal government has put us in. Spending cuts are needed also, but all of this needs to have a healthy balance. No one wants to pay the piper and as a result nothing gets done.

    Take control of the money supply out of the hands of the Federal Reserve. Void all of the illegal executive orders that Obama has placed into effect since he and the wealthy elite/banks/corporations hijacked our presidency. Make the Supreme Court investigate Obama and once and for all tell the American public who he really is. The majority of the previous presidents have been put into office by the wealthy elite. Abolish all corporate lobbyists so that new parties stand a chance at winning elections. The so called two party systems are now one party. Take back our media from the banks and corporations so we can get some journalist who will do some real investigating and print/publish the truth.
    Stop the drone spying, phone tapping, illegal arrest without trials, national ID cards and RFID chips, Obama care, and put some Godly people in office who have some real common sense. People who are willing to conduct themselves like adults and not five year old children fighting over who took their toy away. I believe high school dropouts could have done a better job than the politicians that we have had over the past forty plus years. We do not want NAFTA, United Nations-one world government, one world religion, and we can certainly do without their propaganda fear campaigns designed to get us to give up all our rights and keeping us in never-ending perpetual wars.

    We do not need the Federal Government to protect us; just take a look at the job they have done thus far! They have sold out to the wealthy elite and corporations both foreign and domestic. They are attempting to develop a civil police force and to militarize our local police forces in order to totally control the public. They have bankrupted our country. They continually lie and deceive us. We have failed ourselves by continuing to elect politicians who are liars, cheaters, corrupt, and self concerned. One cannot elect a known liar and expect him/her not to lie to them. A man who commits adultery in the White House is no more trust worthy than a murderer. That is why God hates liars!

    Wake up America, get your heads back into your Holy Bibles and learn some good moral truths. If society is not willing to be held morally accountable, then neither will the politicians! God’s Kingdom is a system of government that works not manmade governments. Just look at history to see how all manmade governments have failed miserably. Everybody wants to do their own thing; “your truth is your truth” and “my truth is my truth.” Not so, God’s truth is the only real truth and always has been. If one holds passionately to God’s truth, then they will demand that society and government do the same, which will lead to truth and justice for everyone. Seriously people, God is the only answer to our current situation and if we as a whole do not turn back to him and follow his ways we are all doomed!

    And what about this one world government that the politicians and the media are always talking about? Governments around the world are failing including ours and they think we should put our futures into their hands? What happens when this one world government also fails? Then the whole world is doomed! Everyone wants to be their own God, and rebel against the one true God. This rebellion if it continues is going to cost all of us dearly! Now the media is beginning to discuss so called aliens. Will this be the next threat to our existence or the so called saviors everyone has been looking for? The age of enlightenment? Really? If you want some enlightenment just open your Holy Bible! These so called aliens if they are real, they are not what your government will tell you they are. Just another fear campaign and/or more deception.

    People have been having alien sightings for many years; if they are real and if they are here for our greater good then why haven’t they done something before now to make a real difference in our world? And by the way the so called aliens, if they are real, are nothing more than fallen angels!! Our only true Savior is Jesus Christ and as soon as people begin to finally accept this reality then things will begin to turn around! One can laugh at me for calling the so called aliens fallen angels, but can one truly say, they do not believe there is a Satan? Just look at the world around you to prove Satan is very real and working in this world right along with his fallen angels! This is a spiritual war, not a war against other human beings, and that includes the politicians, wealthy elite, bankers, and corporations.

    Don’t people realize that God is the one who puts leaders in their positions? And this is based on society and the moral and/or immoral condition it is in. Follow God and get Godly leaders, by default follow Satan and get an evil leader that is just the way it goes. Just look at Israel’s history to see this reality! When Israel was following God they prospered, when they turned away from him and started worshipping false/pagan gods and/or self they were conquered and taken into captivity! History repeats itself and Israel has a long history of repeating the same mistakes.

    What about the new Pope just around the corner and Islam, not to mention all the other world religions? Are we going to be duped into following a false religion designed to convince us that, that is our only salvation? America is a Christian nation and always has been. We do not need a manmade religion to save us. Even though the politicians and the media are telling people that America is not a Christian nation, does that make it true? Since when lately have your politicians and media told you the truth? The Holy Bible is the only book that has withstood the test of time and even today those scientists who are willing to be honest are showing us that they can and have proven the existence of God! Turn to God people and earnestly pray for our country, this is our only true hope for this nation’s redemption!

        FEMA is inept at helping the Sandy storm damage victims.

        And
        Obama is doing all he can to shut down the coal and oil energy businesses.
        And not cut a dime of entitlements.

    Although Marx advocated the use of any means, especially including violent revolution, to bring about socialist dictatorship, he suggested ten political goals for developed countries such as the United States. How far has the United States — traditionally the bastion of freedom, free markets, and private property — gone down the Marxist road to fulfill these socialist aims? You be the judge. The following are Marx’s ten planks from his Communist Manifesto. 1. Abolition of private property in land and application of all rents of land to public purpose.
    The courts have interpreted the 14th Amendment of the U.S. Constitution (1868) to give the government far more “eminent domain” power than was originally intended, Under the rubric of “eminent domain” and various zoning regulations, land use regulations by the Bureau of Land Managementproperty taxes, and “environmental” excuses, private property rights have become very diluted and private property in landis, vehicles, and other forms are seized almost every day in this country under the “forfeiture” provisions of the RICO statutes and the so-called War on Drugs..

    2. A heavy progressive or graduated income tax.
    The 16th Amendment of the U.S. Constitution, 1913 (which some scholars maintain was never properly ratified), and various State income taxes, established this major Marxist coup in the United States many decades ago. These taxes continue to drain the lifeblood out of the American economy and greatly reduce the accumulation of desperately needed capital for future growth, business starts, job creation, and salary increases.

    3. Abolition of all rights of inheritance.
    Another Marxian attack on private property rights is in the form of Federal & State estate taxes and other inheritance taxes, which have abolished or at least greatly diluted the right of private property owners to determine the disposition and distribution of their estates upon their death. Instead, government bureaucrats get their greedy hands involved .

    4. Confiscation of the property of all emigrants and rebels.
    We call it government seizures, tax liens, “forfeiture” Public “law” 99-570 (1986); Executive order 11490, sections 1205, 2002 which gives private land to the Department of Urban Development; the imprisonment of “terrorists” and those who speak out or write against the “government” (1997 Crime/Terrorist Bill); or the IRS confiscation of property without due process.

    5. Centralization of credit in the hands of the state, by means of a national bank with state capital and an exclusive monopoly.
    The Federal Reserve System, created by the Federal Reserve Act of Congress in 1913, is indeed such a “national bank” and it politically manipulates interest rates and holds a monopoly on legal counterfeiting in the United States. This is exactly what Marx had in mind and completely fulfills this plank, another major socialist objective. Yet, most Americans naively believe the U.S. of A. is far from a Marxist or socialist nation.

    6. Centralization of the means of communication and transportation in the hands of the state.
    In the U.S., communication and transportation are controlled and regulated by the Federal Communications Commission (FCC) established by the Communications Act of 1934 and the Department of Transportation and the Interstate Commerce Commission (established by Congress in 1887), and the Federal Aviation Administration as well as Executive orders 11490, 10999 — not to mention various state bureaucracies and regulations. There is also the federal postal monopoly, AMTRAK and CONRAIL — outright socialist (government-owned) enterprises. Instead of free-market private enteprrise in these important industries, these fields in America are semi-cartelized through the government’s regulatory-industiral complex.

    7. Extension of factories and instruments of production owned by the state; the bringing into cultivation of waste lands, and the improvement of the soil generally in accordance with a common plan.
    While the U.S. does not have vast “collective farms” (which failed so miserably in the Soviet Union), we nevertheless do have a significant degree of government involvement in agriculture in the form of price support subsidies and acreage alotments and land-use controls. The Desert Entry Act and The Department of Agriculture. As well as the Department of Commerce and Labor, Department of Interior, the Evironmental Protection Agency, Bureau of Land Management, Bureau of Reclamation, Bureau of Mines, National Park Service, and the IRS control of business through corporate regulations.

    8. Equal obligation of all to work. Establishment of Industrial armies, especially for agriculture.
    We call it the Social Security Administration and The Department of Labor. The National debt and inflation caused by the communal bank has caused the need for a two “income” family. Woman in the workplace since the 1920′s, the 19th amendment of the U.S. Constitution, the Civil Rights Act of 1964, assorted Socialist Unions, affirmative action, the Federal Public Works Program and of course Executive order 11000. And I almost forgot…The Equal Rights Amendment means that women should do all work that men do including the military and since passage it would make women subject to the draft.

    9. Combination of agriculture with manufacturing industries; gradual abolition of the distinction between town and country by a more equable distribution of the population over the country.
    We call it the Planning Reorganization Act of 1949 , zoning (Title 17 1910-1990) and Super Corporate Farms, as well as Executive orders 11647, 11731 (ten regions) and Public “law” 89-136.

    10. Free education for all children in government schools. Abolition of children’s factory labor in its present form. Combination of education with industrial production, etc. etc.
    People are being taxed to support what we call ‘public’ schools, which train the young to work for the communal debt system. We also call it the Department of Education, the NEA and Outcome Based “Education” .

    So, is the U.S. a “free country” today? Hardly! Not compared to what it once was. Yet, very few Americans today challenge these Marxist institutions, and there are virtually no politicians calling for their repeal or even gradual phase-out. While the United States of America may still have more freedoms than most other countries, we have nonetheless lost many crucial liberties and have accepted the major socialist attacks on freedom and private property as normal parts of our way of life. The nation, whose founders included such individualists as Thomas Jefferson, George Mason, James Madison, John Adams and Patrick Henry, has gradually turned away from the principles of individual rights, limited constitutional government, private property, and free markets and instead we increasingly have embraced the failed ideas and nostrums of socialism and fascism. We should hang our heads in shame for having allowed this to happen.
    But, it is not too late to reverse these pernicious burdens and instead enact pro-freedom reforms to put our nation back on track again. It can be done.
    In some ways the Left has a head start over us on the pro-freedom Right. The enemies of American freedom do admittedly dominate the entertainment industry, television news media, and academia — but we have the tremendous strategic advantage that reality (including man’s nature) is on our side; so, unlike the socialists and “liberals” (welfare-state fascists), we are not in the position of having to advocate a system which constantly tries to “make water to go uphill” — or force human beings into a rigid utopian staitjacket based on the whims of some clique of central planning bureaucrats. We know that individual freedom for peaceful people within a constitutional republic works in practice; our country’s history demonstrates that. The piecemeal abandonment of those principles and institutions which once made America great has proved to be a a dead-end road to failure. That is why I tend to be a long-term optimist even though things often look pretty glum in the meantime. Just as Prohibition was eventually repealed, I feel encouraged that such key statist achievements as the income tax, government schools, fiat money/central banking (the Federal Reserve), “environmentalist” regulations, property forfeiture laws, and other Marxist planks and leftist institutions can be rolled back and repealed altogether, although it may take several decades.
    Those who would carry forward the ideas and principles of self-ownership, private property, free markets, laissez faire, the rule of law, and constitutionalism which informed America’s founders must become more active on the key ideological battle fronts. We need more influence not just in politics, but in areas of entertainment, academia, journalism, think tanks, churches (we need our own individualist Walter Rauschenbushes), literature, art, and other venues of expression and activism.
    Marxism and socialism have proved to be colossal failures all over the world. As Frederic Bastiat wrote in his classic The Law just prior to his death, “let us now try liberty”!

    I think that a flat tax is the only fair way to tax citizens, and, that it should not be a federal tax, it should be at the state level, or territory level, only. Each state could determine what rate best works there, and the citizen may wish to move to a different state because the tax ratio is cheaper, or elect to stay because the benefits are better.
    The federal government would then tax each state or territory a flat percentage, for each person living there, whether tax paying or not, to arm our military, and national guard, and regulate laws that concern the union. This rate could differ state, to state, based on what each states’ burden is to the union, and special taxes to fund wars, or rebuild after natural causes, would require voting.
    This is an obviouslly simplified look at how a simple tax code would work, but the one we have now makes no sense, and wastes so much. Our goverments shouldnt be complicated, they should be easy to know, and easy to trust.

      democracies in the early greek city states produced the wildest excesses of goverment imaginable. In evrey case they ended up with mob rule then anarchy and finally tyranny under an obligarchy. During that period in greece there was a man named solom who urged creation of a fixed body of law not subject to majority whims. While the greeks never adopted soloms wise council the romans did. Based on what they knew of soloms laws they created the 12 tables of the romon law and in effect built a republic that limited goverment power and left the people alone. Since goverment was limited people were free to produce with the understanding that they could keep the fruits of their labor. In time rome became wealthy and the envy of the world. In the mist of plenty hovewer the romon people forgot what freedom entailed. They forgot that the essence of freedom was the proper limitation of goverment. When goverment power grows peoples freedom receeds. Once the romons dropped their gaurd power seeking politicans begin to exceed the powers granted to them in the romon constitution. Some learned that they could use goverment power to take property from some and give it to others. agriculture subsidies were introduced followed by housing and welfare programs. Inevitably taxes rose and control over the private sector were imposed. Soon a number of romes produces no longer could make ends meet and they went on the dull. Productivity declined, shortages developed, and mobs begin roaming the streets demanding bread and circuces from the goverment. Many were induced to trade freedom for security.
